1. Who we are
CardTrading (cardtrading.eu) is operated by QUALIAX TECHNOLOGIES, S.L. (“CardTrading”, “we”, “us”), a company incorporated in Spain, with registered address at [REGISTERED ADDRESS], tax ID [CIF], registered in the Mercantile Registry of [REGISTRY DETAILS]. Contact: support@cardtrading.eu.
2. What CardTrading is
CardTrading is an online marketplace that allows private individuals to buy and sell trading cards and related collectible products between themselves. CardTrading is an intermediary: we are not a party to the sales contract between buyer and seller, we never own, hold or ship the items listed, and we do not guarantee their condition, authenticity or grading beyond the tools we provide. The sales contract is formed directly between the buyer and the seller.
3. Accounts and eligibility
You must be at least 18 years old and have full legal capacity to use CardTrading. You must provide accurate information when registering, keep your credentials secure, and verify your email address. You are responsible for all activity under your account. We may suspend or terminate accounts that breach these Terms, applicable law, or that present fraud or abuse risks.
4. Buying and selling
Sellers list items with a description, condition, language and price, and are responsible for the accuracy of their listings. Sellers may also receive and accept purchase offers (“bids”) on eligible items. When a purchase is completed, the seller must ship the item promptly, adequately protected, with tracking where offered, directly to the buyer. Buyers must pay through the platform and confirm receipt once the item arrives. Orders not confirmed by the buyer are automatically marked as completed 14 days after shipment, unless a dispute has been opened.
5. Prices, fees and payments
Payments are processed by Stripe through Stripe Connect. CardTrading does not hold client funds. Sellers must complete Stripe’s onboarding, including any identity verification Stripe requires. CardTrading charges the Seller a commission on each completed sale, ranging from 6% to 10% of the sale price depending on the Seller’s tier. New sellers start at 10%; reduced rates apply based on completed sales volume and identity verification, as displayed in the Seller’s account — see our Fees page for current rates. CardTrading reserves the right to modify commission rates with prior notice. Reference prices (“CT price”, market prices and price history) shown on the platform are informational estimates only and do not constitute financial advice or a guarantee of value.
6. Shipping, delivery and completion
Shipping is the seller’s responsibility. Risk in the item passes according to applicable law governing the contract between buyer and seller. Buyers should inspect items on arrival and either confirm delivery or report a problem without undue delay.
7. Disputes between users
If an item does not arrive, arrives damaged, or is not as described, the buyer may open a dispute from the order page: while an order is disputed it cannot be completed. Both parties can communicate in the dispute thread and CardTrading may mediate and issue a resolution, which may include a refund processed through Stripe. Buyers may open disputes from shipment until 30 days after order completion. Our resolution of a dispute is limited to the platform transaction; it does not limit either party’s statutory rights.
8. Right of withdrawal
Sales on CardTrading are currently made between private individuals (consumer-to-consumer). The statutory 14-day right of withdrawal for distance contracts applies to sales by professional traders and therefore does not apply to purchases from private sellers. If professional sellers are admitted in the future, their listings will be identified and the corresponding consumer rights will apply to them.
9. Prohibited conduct
You may not: list counterfeit, stolen or illegal items; manipulate prices, bids or the reputation system; circumvent platform fees by completing sales outside the platform after initiating contact through it; use the platform for money laundering or any unlawful purpose; scrape or misuse platform data; or interfere with the platform’s operation.
10. Content and reviews
Buyers may leave reviews after completed orders and sellers may respond. Reviews must be truthful and respectful. We may remove content that is unlawful, abusive or fraudulent. You grant us a non-exclusive licence to display the content you post on the platform.
11. Intellectual property
Trading card names, images and trademarks belong to their respective owners (e.g. the publishers of the card games). CardTrading uses them solely to identify the products being traded. The platform, its design and its software are property of QUALIAX TECHNOLOGIES, S.L.
12. Liability
To the extent permitted by law, CardTrading’s liability is limited to damages caused by our wilful misconduct or gross negligence, and in any event to the fees we received for the transaction concerned. We are not liable for the conduct of buyers or sellers, the accuracy of listings, or losses derived from reliance on reference prices. Nothing in these Terms limits liability that cannot be limited under applicable law, nor consumers’ statutory rights.
13. Termination
You may close your account at any time. Obligations arising from transactions initiated before closure survive. We may modify or discontinue the service with reasonable notice.
14. Changes to these Terms
We may update these Terms. Material changes will be notified through the platform or by email with reasonable advance notice. Continued use after the effective date constitutes acceptance.
15. Governing law and jurisdiction
These Terms are governed by Spanish law. Disputes with us will be subject to the courts of [CITY], Spain, without prejudice to mandatory consumer jurisdiction rules. Consumers may also use the EU Online Dispute Resolution platform (ec.europa.eu/consumers/odr).
